Accidents while on holidays
We all enjoy holidays, but unfortunately accidents can occur. This can be stressful for the injured party and their family. A common example of an accident on holidays is when a you slip and fall at a pool side or in a hotel. Even though the accident has occurred outside of Ireland; a claim can still be taken in the same way as if the accident had occurred in Ireland. There are certain limitations to this and these are set out in Statute and case law. As these types of cases are by their nature more difficult, it is best to consult a personal injury solicitor as soon as possible for advice.
We at Berwick Solicitors Galway have seen a wide range of injuries arising from such incidents such as back injury, shoulder injury, fractured ankles, fractured wrist, facial injuries, brain injuries etc. These injuries can have a detrimental effect to the life of the injured party as they may lead to an inability to work.
In order to bring a successful personal injury case, the circumstances of your case must fit into the criteria set out in the Holidays Acts. If possible, it is always a good idea to take photographs of where the accident occurred as this will help your solicitor understand the location.
Claims for personal injuries sustained on holidays are processed firstly through the Injuries Board and if they are not resolved, they may then proceed into the Court process. If you sustained a personal injury as a result of an accident on holidays, you may be entitled to claim and you should contact your personal injury solicitor for further advice on the matter.
