Where a person dies as a result of incorrect medical treatment, a case may be pursued against that wrongdoer. This is called a fatal injury claim. Generally, the case is taken by the family or children of the deceased.

When someone dies in hospital or where they were being treated for an illness by a doctor within one month of that person’s death, a Coroner’s inquest is usually held to establish the cause of death.
